1. Agreement to Terms

By accessing or using Classync ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Classync is an AI-powered learning assistant designed to help students maximize their learning efficiency through automated lecture processing, transcription, summarization, and personalized quiz generation.

2. Description of Service

Classync provides the following services:

• Lecture Copilot: Automated lecture audio/video transcription using Groq Whisper API
• AI Summarization: Intelligent lecture summarization powered by OpenAI GPT-4, including key points, examples, and common mistakes
• Quiz Generation: Automated quiz creation with multiple-choice and short-answer questions based on lecture content (powered by OpenAI GPT-4)
• Performance Analysis: AI-driven analysis of quiz results with personalized study recommendations
• Course Management: Organization tools for managing multiple courses and lectures

3. User Accounts and Registration

To use Classync, you must create an account and provide accurate information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current registration information

You must be at least 13 years old to use Classync. If you are under 18, you must have permission from a parent or guardian.

4. Subscription Plans and Billing

Classync offers multiple subscription tiers:

• Free Plan: Limited access to basic features (3 hours/month)
• Beta Plan: Early access to features for beta testers
• Basic Plan: Access to core features with 20 hours/month (monthly) or 80 hours/semester
• Pro Plan: Full access to all features including Exam Prep Quiz Generator with 50 hours/month (monthly) or 200 hours/semester

Payment Processing: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

By subscribing to a paid plan:

• You authorize recurring charges to your payment method
• Subscriptions automatically renew unless cancelled
• Prices are subject to change with 30 days notice
• You can cancel your subscription at any time from your account settings

5. Refund Policy

Classync offers a 14-day refund period in accordance with Paddle's Buyer Terms. Before subscribing, we strongly encourage you to test our service with the free tier (3 hours/month) to ensure it meets your needs.

• 14-Day Refund Window: You may request a full refund within 14 days of your initial purchase
• Important Exception: By downloading or using the Service (uploading lectures, generating summaries, taking quizzes), you consent to immediate performance and acknowledge that you will lose your right to refund once service usage has begun
• Free Tier Available: Test the service thoroughly with 3 free hours per month before committing to a paid plan to avoid any issues
• Cancellation: You can cancel your subscription at any time from account settings. You will retain access until the end of your billing period
• Billing Errors: In cases of billing errors, extended service outages, or fraudulent charges, please contact us immediately

6. Acceptable Use Policy

You agree not to:

• Upload content that violates copyright, trademark, or other intellectual property rights
• Upload malicious content, including viruses or malware
• Use the Service for any illegal purpose
• Attempt to reverse engineer, decompile, or access the source code of the Service
• Share your account credentials with others
• Abuse, harass, or harm other users
• Scrape, crawl, or use automated tools to access the Service without permission
• Upload content that is not your own or that you don't have permission to use

7. Content and Intellectual Property

Your Content: You retain ownership of all content you upload to Classync (lecture recordings, notes, etc.). By uploading content, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service.

Our Content: The Classync platform, including its design, features, AI-generated summaries, quizzes, and recommendations, is owned by Classync and protected by intellectual property laws. You may not copy, modify, or distribute our platform or content without permission.

AI-Generated Content: Summaries, quizzes, and recommendations generated by our AI are provided to you for your personal educational use. You may use this content for your studies, but may not redistribute or commercialize it.

8. Privacy and Data Usage

Your privacy is important to us. We collect and use your data as described in our Privacy Policy. Key points include:

• We store your uploaded lectures, transcripts, and quiz data securely using Supabase
• We use Groq's API for transcription and OpenAI's API for content generation; neither service uses your data to train their models
• We do not sell your personal data to third parties
• You can request deletion of your data at any time

9. AI Accuracy and Limitations

Classync uses artificial intelligence to generate transcripts, summaries, and quizzes. While we strive for accuracy:

• No Warranty: AI-generated content may contain errors, inaccuracies, or omissions
• Educational Tool: Classync is a supplementary learning tool and should not replace attending lectures, reading course materials, or studying independently
• Verification Required: Always verify important information from authoritative sources
• Not Professional Advice: Content generated by Classync does not constitute professional, medical, legal, or financial advice

10. Service Availability and Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Impose limits on file uploads, storage, or processing time
• Update features and pricing with reasonable notice
• Perform scheduled maintenance that may temporarily interrupt service

We are not liable for any interruption, delay, or unavailability of the Service.

11. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the Service or harm other users
• Fail to pay subscription fees

Upon termination, your right to use the Service will immediately cease. We may delete your account data, but will provide reasonable opportunity to export your content if requested.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "as is" AND "as available" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OF YOUR DATA OR PREVENTION OF UNAUTHORIZED ACCESS

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASSYNC SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF DATA, PROFITS, OR GOODWILL
• ACADEMIC CONSEQUENCES RESULTING FROM USE OF THE SERVICE
• DAMAGES EXCEEDING THE AMOUNT YOU PAID IN THE LAST 12 MONTHS

14. Indemnification

You agree to indemnify and hold harmless Classync from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
